Start-up legal training sessions

Betagroup, BetaCowork and Field Fisher Waterhouse have partnered to bring all the Betagroup community a new series of free training sessions covering practical legal issues for start-ups, with a particular emphasis on the internet and web industry.

The purpose is to provide the participants with a basic knowledge of essential legal issues in corporate, IT, IP and commercial contracts.

Each session conducted in English will address a specific topic and will be presented by lawyers specialised in their field. The presentations will be to the point, non-academic and will handle the subject with pragmatic approach, based on previous experience.

The sessions will be followed by a Q&A and a drink where you will be able to ask your questions and share experiences with speakers and participants.

Which brings us to the subject of our eleventh session:

"Intellectual property & Commercial contracts"

1/ Intellectual property : "Open licenses"

Since most of the start-up companies will be using or even producing open source content (software or even music, pictures and content), we propose to explore the basic principles behind open licenses. There has already been several decision by european courts in this area and we can briefly take a look at them to illustrate in a very practical way the risks associated with the use of open content when you do not comply with the licenses.

Hakim Haouideg“Hakim Haouideg specialises in contentious and non-contentious intellectual property and IT law. He assists clients in drafting and negotiating IT agreements (licensing, consulting & outsourcing). He also assists research-driven undertakings on R&D and technology transfer agreements. Prior to joining the bar, Hakim worked for three years as an in-house counsel at the technology transfer office of the Univerity of Namur where he was in charge of licensing agreements and spin-off companies.”

2/ Commercial contracts : "Contractual Litigation"

Early termination of the contract and consequences of termination;

Force majeure and hardship : may I terminate the contract or at least renegotiate the prices whereaan unforeseen event either renders contractual obligatons impossible, or radically changes the economical balance between parties.

Enforcement of the contract : what are the specific remedies in case of non payment of my invoices ?

Damages : what are the principles of the compensation for damages under Belgian law

Jean-Francois Germain“Jean-François Germain has expertise in commercial and liability disputes. He assists his clients at each pre-contentious and contentious stage, helping them in anticipating and assessing risks, managing situations, setting objectives and tactics. He also has an extensive experience and expertise working on a broad range of complex contract issues, involving areas such as outsourcing and consultancy or system integration. He is acting for both suppliers and users, which gives him an accurate understanding and a sound approach of commercial issues.”

The presentation will be an hour long, followed by Q&A and a drink to keep on asking questions to the speaker.

Who is it for?
