Dying to Make Money – are you joking?

I spent part of my Labor Day Weekend getting current on my required reading. From the pile of magazines that invade my mailbox monthly to a week’s worth of various and sundry newspapers, which I still get in that good old-fashioned printed way (quaint I know), I sit down with a 20-ounce, home-brewed java and get to reading.

My ‘reward’ for knocking down the sizeable pile of print media is to get to the Sunday New York Times, which usually means that I am reading it by midweek. This weekend however was the exception as I actually earned my time with the Times, and got to it by late Sunday afternoon.  

That enjoyment was however short-lived as one of the cover stories sent me immediately into a “you’ve got to be kidding” rant. Specifically, it was a story about yet another exotic investment scheme emerging on Wall Street. Like the catastrophic credit default swaps that helped create a global recession, this new scheme likewise creates no real product or value, enriches a few who package and rate this garbage, and will ultimately have unintended consequences that will have us all asking after the fact, "What were we thinking!?"

The scheme in question is packaging life insurance policies from holders that, in essence, short their own policy by taking a significantly reduced distribution prior to their impending demise. The investors then hold those policies until the inevitable passing of the insured and then collect the face value of the policy – usually as much as 60% greater than what the insured received. This is to say nothing of the insured’s estate which may likely get stuck with unpaid medical bills, taxes, and burial expenses.

The way it was originally intended by the insurance industry, it was a benefit for those who get the terrible news of a terminal condition. The Living Benefit as it is referred to, was intended to provide an option for comfort or directed allocation while the insured is still alive. Of course the insurance companies are acting in their own self interest in offering this product (rider) as they too discount what would have been a larger death benefit.

With this aggregation and productizing of such “investments” however, we will slither to new depths as we seek returns by way of people dying – in large numbers.

One of the crazy debunked distractions of the healthcare debate has been the existence (not) of so-called death panels. If this investment vehicle goes mainstream, we may yet see the formation of death panels. And the irony of it will be that they will actually have an incentive to lobby against healthcare reform or the offering of any life extending treatments as they only cash out when someone dies. This is sick and twisted … even by Wall Street standards.

I think you are wrong on the point about healthcare reforms. The way I see it is - insurance companies are discounting ones insurance based on a discount rate and the approximate time till their death. That is, if someone discounts his insurance 5 years before he is supposed to die, he will receive a lower amount than the person who is supposed to die in 2 years.

Although, insurance companies cash out only when someone dies, the profit they make is directly proportionate to the time-till-death. Hence, healthcare reforms should, ideally, be promoted to increase the discounting term. Moreover, a longer discounting term would also allow insurance companies to add a risk premium to the discounting rate; hence further increasing their profits.

The US Health care is a system that sort of lies in the weeds until people are very, very sick, and then rushes in with extraordinarily marvelous and expensive high technology to help you recover on the back end. Doctors, patients and policy-makers all have ideas about why the health care system is in critical condition and it'll only get worse if we let the suits and business men decide how to run the system.

the fact is that people will not stop coming up with new 'ingenious' ways to make money. It is up to the govt to step in and make such acts unlawful and send these guys to jail just has they have done with things like ponzi schemes.

it would have been interesting to see the govts let all the bad banks fall over. That way they get their just deserves. As it is now, the world is still driven by debt and living in excess.

I heard recently that a bank can take out a claim against you for life insurance. This way, they get paid 1.5 million if you die... Oh and your family, well they get nothing. The system is far more screwed up than any of us could even fathom...

The only investment scheme that most people should consider, is long term, proven strategies.

This type of life insurance is really questionable. Where I can see how it would be a great help in some circumstances for those with terminal illness and no resources for care, it might also be unfair to those left behind. I think that with collaboration with couples and within families it could work.

At some point in the future, when many people who opted to get their money sooner begin dying in droves the insurance companies will inevitably default and the government will have to have a massive bailout. Congress should make these investment vehicles illegal.

I'm quite certain this kind of thing would not last long in Australia because almost every industry has regulatory bodies that would prevent it.

Isn't the problem really the short sightedness and irresponsibility of the original policay holder/life insured?

It is them that is making the decision to leave their estate short of cash. Possibly even fraudulently, if they have used the existance of the insurance as evidence that they can afford healthcare etc.

Having read all about "productization" of bad debt and the resultant chaos it caused across the country and further afield - this smells like vested interests gone wild. Maybe there are some tangible benefits for a percentage of those getting sold this but on the whole it's probably more likely to cause grief.

This is something very absurd that we don't get to read in the newspapers everyday. The fact that the New York times has even published it is shameful. I believe there has to be something such as 'respect for life'. Well, this is not something that can be deemed as illegal or against laws but it doesn't seem ethical or atleast it is surely a debatable topic.

The thing is doctors, patients and policy-makers all have different goals. Patients – want to have good affordable health care, doctors want to have a job and be paid nice salary; and policy-makers – want to make money. All of them have different ideas about why US health care system is in critical condition. Big business makes the rules and the consumer and/or the everyday tax paying citizen has to pay the price sometimes with their lives. The sad part is we have no choice but to buy health insurance, or mortgages, or take out credit cards as our lives revolve around these services and they make the rules.

This is nothing new. When I was younger a friend of mine had a life insurance scam where the company only insured older people. The policies were expensive but there were huge referral fees because of the impending death of people. I think ill just stick to selling my McFarlane Sports toys.

I can't believe this is legal! The US insurance business is the worst business there is and that goes for all of them: life insurance, auto insurance, home owner's insurance etc. I'm from Sweden and things, when it comes to insurances, are much better. I now live in Florida and don't even get me started on home owners insurance down here. We've got a $15,000 deductible for anything storm related (law minimum, 2%). Absolutely ridiculous!

Because everyone insured will ultimate pass away and the investors will demand their money and only a few people, the scoundrels running this type of game will benefit from it all. I don't see why the insurance companies need to package up these natural risks and sell them off. I agree this is a bad idea. Has any good come from any "financial product innovation" in the last decade? We need to keep the risks with the diversified company shareholders. The old system worked because we had incentives aligned where the people taking the risks could judge them vertically.

This is an entirely twisted way of making money. As the debate nowdays, we need to put people before anything else. Investors need to be curbed from speculating or even dealing in such 'derivatives' to protect the general public from the resulting hazards.

This is low by any standard. First, I don't know why I haven't heard about this. I must have missed that article and maybe it wasn't picked up by many other resources. Anyway, are you surprised by this? When it comes to cheating people out of their money "legally" the wall street boys have it down to an exact science. The irony of the possible death panels this could create is humorous to say the least.

The lesson of the story is that we should all be cautious enough in dealing with insurances and other things related to this post. People should study closely on how these insurance companies run and ask for quality services that they have been offering. Health is very much important as far as we are all concerned but we should not be desperate and make risky moves with regards to this matter.

This story reminds me of the old saying, "avarice is the root of all evil". What good is making money if you have to make it in this fashion? Believe it or not, when the aids epidemic hit in the 80's and early 90's a similar scheme emerged. Because treatments were relatively ineffective in the early years of this crisis, mortality rates were unfortunately quite high within the first five years of diagnosis. This prompted groups of heartless investors to buy-up the life insurance policies of aids patients at a fraction of the death benefit value. The ironic thing was that these investors were touting their "service" as a humanitarian effort, as they provided a way for the patients to get their financial affairs in order before they passed. I guess some people will do anything for money.

I first heard of this back when the AIDS crisis hit. HIV was considered a death sentence, and guys would cash in their policies because they couldn't work and, too often, they had no insurance.

The kicker to that story is that the people buying the policies were betting on HIV causing a high mortality rate. Instead, treatment improved, and the ROI on the policy dropped dramatically.

Hey, Just for your info The National Health Service works OK in the UK. OK it has had it's problems with waiting times going in to months and sometimes years in cases but these have been resolved now and it's a fair and essential system for all demographics. You can still pay to go Private though if you wish! SuzieH

Greed is one of the biggest problems with business today. The bottom line is often more important than peoples lives. Sure, a company needs to make a profit, but it should be balanced with the needs of the people.

I just try to do my due diligence about who I do business with and avoid those companies that are just after the almight dollar.

Insurance companies are for profit organizations, what else can you expect from them other than doing their best to make more money for their share holders.

They have to increase profits, or they will lose their jobs. Its up to consumers to realize how good or bad a product is based on its merits.

Personally I think the whole insurance industry is a rort, sure it helps a few, but most of us just pay, pay, pay our entire lives and never get anything back.

The problem is that it's all about the money up to the point you are diagnosed with something yourself. This only happens once in your life after which you die and then you have different things to worry about so you stop doing your job to have that 'last good time with your spouse'. If all managers in insurance companies were terminally ill, the world would look quite different as they can see, only then, how insane they are.

With regards to the investment vehicle that you speak of, they seem to be much of the same vehicles wrapped in different packing. One of the main things to realise is that the actually paper currencies have very little intrinsic value so it's going to be even harder for the derivitives to offer any more.

However, this policy seems to benefit the holder of the insurance: I think he or she should be free to cash in prior to dying.

The problem is people just believe what their told. If their financial advisor/insurance broker/sales person says they should get that, thats what people will do because they trust their "advisor". When actually what their dealing with is their sales person disguised as their friend and advisor. So never be afraid to go out and do your own research...

Being in business is to make money and we all already know that no body or business entity that will care for you, even for an insurance company. I'm not saying that insurance is bad but they are in the business to make money too by borrowing from you and in return provide you with so call calculated risk protection.

However,the way it gets evolved now really scared me. If such scheme is allowed in the market, then the main purpose of insurance has lost. The basic premise for insurance is protection from losses (though it is different in case of life insurance) and not for profits.

I agree with what you have said in the final paragraph. It's really sick and a pathetic way of milking money from death people.

Healthcare reform is just another way for government can make money off the backs of the middle class. This is a way to give money back to those that provided campaign contributions and also to ensure re-alection next time around. The whole idea of reform is politically driven for the presidents agenda. Lets face it, we are all doing to pay additional taxed for the next three years without anyone benefiting from this reform, then right at election time, they will actually implement the plan so that the public will praise him for actually providing healthcare. Does it at all surprise you. Where there is a way someone will always find a way to exploit the system.

It will only take time for some regulation to be put in place. I really don't think that the insurance company is to blame on this one though. It is completely customary to apply a big/huge discount rate on an early "pull-out" of benefit.

When filling out a survey probing the market to gather opinions on an unnamed insurance company's suggestions for a new series of insurance policies yesterday, I found their questions somewhat disturbing, and even though they had sugar-coated it for us dumb people, it was eerily similar to what's being discussed here. The way it was originally intended by the insurance industry, it was a benefit for those who get the terrible news of a terminal condition. The Living Benefit as it is referred to, was intended to provide an option for comfort or directed allocation while the insured is still alive.?? Really.. so the rich get richer and the poor stay poorer.

We've always been like this since the dawn of humans, we are who are are: selfish. Everyone here knows for a fact that all companies look for is more profit, it's the belief in the "invisible hand" theory (by Adam Smith) that selfless profit seeking entrepreneurs and businesses will in the end somehow benefit the economy in some way, this belief is especially strong in capitalist USA.

The only difference is these insurance companies are going too far, I'd like to believe it will benefit people in some way, but I just don't see it.

But what a lot of people do not think about is the fact that the people with good insurance wind up paying for the people that are under insured or uninsured. I heard recently that a bank can take out a claim against you for life insurance. This way, they get paid 1.5 million if you die... Oh and your family, well they get nothing. The system is far more screwed up than any of us could even fathom...

This has been in existence for a long time. I am not sure what the uproar about it is. If you have a life insurance policy which you paid for and you need money now to live etc, there are people that will give you money to take over as beneficiary. Ultimately everyone dies, but in a way they take some risk in how long you stick around - 1 year, 5 years, 15 years etc. They put up money now for a guarantee later on.

I am sure as in all things of this nature, there are unscrupulous people who prey on people who don't know any better and trick them into far too little money.

Some police holders invest a lot of money in this scheme and suffer when they have medical problems as they are not able to pay medical bills which may lead to death. I used to work for an insurance company myself. It was life assurance but instead car/van and home inusrance. I get amazed all the time how much they put aside for which they use the pool of funds for. It is honestly surprising the amount of flexibility they have from the government.

In germany, switzerland and austria the market is getting flooded now with salespeople who buy life insurances, I just spoke to a guy who works in one, they have 4500 agents who get people to sell them their life insurance. They tell the contract owner that he gets 200% of what the life insurance is worth. Other companies do it too, but promise less, like 100%, which according to your blog post here, is still a scam. Anyway, the company that gives 200% is on the market since 3 years. It was started with 25k€ Capital, and yet people trust it to pay them 200% back where the biggest part flows in an investment and isn´t even paid out for 5 or 6 or more years. Crazyness. But if you read your Times today or tomorrow you´ll see there´s even crazier stuff going on cos all Banks worldwide are betting / gambling on greece going bankrupt!

Well, if you like the govt. forcing you to do things you may not want to do and getting more involved in your life, then by all means support it. There is a provision in the bill that states you MUST get health insurance or get fined. Employers would get fined as well. So if you do not do what big brother says, you're butt will be in trouble. In the bill there is no option for citizens to opt out of health insurance. If they choose not to get it, they get fined. It's written clear as day and it's been talked about a lot. Even if you can't afford it, you still have to get it. You are being told you have to get insurance or get fined and get in trouble. So if you think that is how govt. should treat it's people, by all means support this socialist plan.

Once the problem hits the fan everyone can then see that this 'benefit' has turned into a major financial headache for many people. Why don't the managers in the financial services industry get a grip of the salesmen and stop these crazy ideas.

There is enough money to be made for their companies through the standard ways of doing business that have stood the test of time without new ideas being foisted on an increasingly fragile economy.

The people with these policies should be shopping them around for a much better exchange rate; that's what I would do for the money or there so old they don't know any better.

I agree with what electric knife has said with reference to essential health care not being left to chance or personal circumstance. You can't put a price on a person's health and agree it should be widely available at an either cheap or free rate, especially in such a financially strong country like USA.

The crazy thing about the so-called death panels is we really don't know the implications of a government takeover of health insurance and what it could mean for Medicare. Many of the claims made are that money would be taken from Medicare to help pay for insurance for the rest of us. They believe they can find cost cutting measure by cutting back on waste and abuse. However the cold reality is that cutting Medicare could very well create less care resulting in increases in death for our seniors who need proper health care the most.

Isn't this exploitation? This just shows the extent to which Wall Street investment banks can go to make money. There most disturbing thing about this "scheme" pertains to the statement: "The earlier the policyholder dies, the bigger the return." I believe the financial incentives within the United States' healthcare system like these might encourage the practice of euthanasia in some case, which is morally and ethically wrong.

Nice...but, in my opinion, the problem is that it's all about the money up to the point you are diagnosed with something yourself. This only happens once in your life after which you die and then you have different things to worry about so you stop doing your job to have that 'last good time with your spouse'. If all managers in insurance companies were terminally ill, the world would look quite different as they can see, only then, how insane they are.

Our health system in New Zealand is similar to UK. However one can take out an insurance policy to enable instant access to hospitals without waiting for public beds to become available etc. However urgent cases are normally attended to under the public scheme without delay. I believe this is totally different in the USA.

I have always been angered by those who didn't have it but yet drove newer cars and lived in nicer houses - then had the nerve to claim bankruptcy when they had a medical emergency. The insurance companies have no interest in doing the right thing, but rather the most profitable thing, and there lies the problem. Health care should be available at a cost and method that is sane, reasonable, and effective. Profitability should be discussed after the success' of treatments and systems have been realized. The insurance industry can still profit in a sane system.

I get amazed all the time how much they put aside for which they use the pool of funds for. Seeing as how we live in a society where manufacturing is essentially sacrificed for the paper markets, it's not really surprising that medical and health insurance would eventually become a traded commodity on the markets.

In the absence of "real products" as in manufactured good to trade, market makers have to come up with alternatives.

Prices go up, prices go down. The market makers still make a hefty fee, so their best interest is just to trade.

Forget the impact on real people.

Lots of insurance in the world has this role for their product policy. Another policy is when we are sick, we can get money. We can also save our money for our child study when he/she is in colledge at 20 years old. And from what I see, in fact, lots of people are interesting with this kind of insurance. I think they have their own motivation or purpose for registering their self on insurance programme. Anyway, I like your opinion.

Thanks for pointing out this latest "innovation" by the financial industry. There seems to be no limit to the creativity of this group in thinking up ways to separate people from their money.

These kinds of stories used to get my blood boiling too, but lately I've concluded that people have to be responsible to read and understand any contract or agreement they enter into.

Just like the so-called mortgage meltdown. What conclusions can we draw from that?

People now should realize that banks or mortgage salespeople may try to trick them with the paperwork and you have to understand anything before you sign it.

Anyway, don't be a victim. Get informed. Read and understand before acting.

I agree with you my friend. But it is not happening in every case and some where government's person connected with those agency illegally and so they are underestimating this activity yet they know about it. The US system is in Crisis. The insurance companies are looking at making money. I would challenge anyone reading this post to read your insurance program, in particular your disability insurance. Really read it, what are your pre-existing conditions? for example, if you are diagnosed with a condition 2 years into your coverage, it is not covered, so you pay. What about non-disclosure, if you miss any condition whether or not you knew about it or not, you are not covered. The Insurance industry is the game to make money, they actively look for ways not to pay. My point is that in the US, there are millions of people not covered, if they get injured they pay. There are also Millions on Millions of individuals who think they are covered and findout through a loophole they are not covered. Hopefully, the reform will be for the better and not the worse. :(

What more evidence do you need, when a hospital is prepared to turn a critically ill or injured person away because they either don't have health insurance or not enough!

My friend even said when the dollar loses its value we may see more wars. Does anyone else believe this to be true?
It is also said that because the dollar is dropping the war might continue on for years to come. I'm kind of worried.

Wake up Seniors. The "reform" legislation in Congress will gut Medicare. Many will have trouble finding a doctor who will see Medicare patients. You may lose your doctor. You WILL face longs waits for services. The government will decide what treatments you may have. Call your Congressmen and Senators. Tell them to KILL THE BILL and start over with common sense reforms.

Or people who wait 6 months or more just for a diagnosis - then another year or two for the needed treatment? The Reality is the WE CAN'T AFFORD THIS! We have a situation now where almost half of the US is being helped/supported by the other half. If you think that the collapse of our economy can't happen, guess again. And who will have health insurance then?

I just spoke with a friend of mine who is selling these types of policies with the sole purpose of cashing them in within a few years, paying the individual off, of course he's attached a 'charity" dividend which mandates that 10% or more go to a ministry, church or other charity organization. The original policy holder receives the remainder and the investors eagerly await his death.

I think it is a highly unethical practice that should be regulated to death. Err..no pun intended
